Business Setup

Set up your LLC for investment property

Our business-purpose loans are vested in an entity. Forming the LLC early keeps title, insurance, and loan documents aligned at closing.
Quick answer

Set Up an LLC for Investment Property: what do investors actually need?

Form the LLC your business-purpose investment property loan will be vested in — operating agreement, EIN, registered agent, and state filing basics. Final eligibility, pricing, and terms are subject to a complete application, credit and property review, and full underwriting.

Key takeaways
  • Form the LLC your business-purpose investment property loan will be vested in — operating agreement, EIN, registered agent, and state filing basics.
  • Every figure shown is an estimate for business-purpose investment property financing only — not an offer or commitment to lend.
  • Simply Approved Mortgages is a licensed mortgage broker (NMLS #2620881), licensed for residential lending in Florida and Colorado and arranging business-purpose investor loans across our approved 37-jurisdiction footprint.
Why it matters

Why you need an LLC for investment property

We lend on business purpose only, and those loans are vested in an entity — not in your personal name. Forming the LLC before you go under contract keeps the purchase agreement, title commitment, insurance policy, and loan documents all reading the same name, which is what a clean closing depends on.

Our loans require entity vesting

DSCR, bridge, fix and flip, and portfolio loans close in an LLC, LP, or corporation. If the entity does not exist yet, the file cannot move to closing.

Liability separation on rental property

Holding rentals in an entity is the standard way investors separate property risk from personal assets. Speak with your own attorney about your situation.

Cleaner ownership when partners are involved

An operating agreement documents members and percentages up front, so guarantor structure and signing authority are never in question at closing.

It starts the entity's own credit identity

Your EIN, business bank account, DUNS file, and vendor accounts all attach to the entity once it exists.

What underwriting looks for

Entity documents we typically request

  • Articles of Organization / Certificate of Formation filed with the state
  • Operating Agreement showing members and ownership percentages
  • EIN confirmation letter from the IRS
  • Certificate of Good Standing (in some states)
  • Registered agent on file in the property state
  • Entity name matching title, insurance, and the loan documents exactly

How it works

  1. 1

Choose the state, name, and members, then file the Articles of Organization.

  2. 2

Get the EIN and sign an operating agreement listing members and percentages.

  3. 3

Send us the formation documents so title, insurance, and the loan can be issued in the entity name.

LLC formation partner — doola: Entity formation, registered agent, EIN, and operating agreement — including formations for non-US founders. Our loans are vested in an entity, so this comes first.

Simply Approved Mortgages LLC is a mortgage broker — not a direct lender, law firm, tax advisor, insurance agency, bank, or title company. The partners listed here are independent companies that set their own pricing, terms, and eligibility. We may receive compensation if you open an account or purchase a service through these links, at no additional cost to you. Using a partner is never required to apply for or receive financing with us, and it does not affect your loan terms. Please do your own due diligence and consult your own attorney, accountant, and insurance professional.

How We Evaluate This Scenario

A DSCR file is judged on the property, not your tax returns: qualifying rent divided by PITIA — principal, interest, taxes, insurance, plus HOA and flood where they apply. Most programs use the lesser of the in-place lease rent and the appraiser's market rent, so a lease signed below market usually caps the ratio no matter how strong the comps look.

Three inputs move the outcome more than anything else: rent support on the appraiser's rent schedule (Form 1007 or 1025), the LTV tier, and the credit tier. Dropping leverage by five points or moving up a FICO band frequently changes pricing more than shopping a different lender does.

Before you write an offer, price taxes and insurance at post-sale levels rather than the seller's current bill. In reassess-on-transfer states and in coastal insurance markets, that single adjustment is the most common reason a deal that penciled at contract fails the ratio at underwriting.

Credit & pre-approval

Why we pull credit for your investor loan pre-approval

Every DSCR / business-purpose loan file needs a tri-merge credit report so we can verify identity, price your rate tier accurately, and confirm reserves and payment history for the underwriter. Cleaner credit typically unlocks a better rate and higher leverage.

Pay for your credit report — SmartPay

Simply Approved Mortgages uses MeridianLink SmartPay to securely collect the credit report fee for your investor pre-approval. Payment goes directly to the credit vendor — not to us — and unlocks your tri-merge report (Equifax, Experian, TransUnion) so your loan officer can price your file.

  • Secure, PCI-compliant checkout hosted by MeridianLink
  • Required for a formal investor pre-approval decision
  • Soft-touch process — your loan officer will guide you through it

Check your credit first — $1 trial at MyITINCredit

Before you apply, it's smart to know exactly where your credit stands. MyITINCredit offers a $1 trial for 15 days that includes all three credit reports and scores (Equifax, Experian, TransUnion), plus ongoing credit monitoring so you can catch errors, dispute inaccuracies, and watch for identity theft.

  • See all 3 bureau reports & scores before your lender does
  • Ongoing monitoring alerts you to new accounts or score changes
  • Fix errors early — cleaner credit can widen your investor loan options
